1. Introduction and Acceptance

These Terms and Conditions ("Terms") govern your use of the Connect Auto Care platform and services (the "Service"). By accessing, browsing, or using the Connect Auto Care website or mobile application (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms.

Connect Auto Care is a platform designed to connect vehicle owners ("Customers") with certified service providers and mechanics ("Service Providers") for vehicle repair and maintenance services. We facilitate connections between Customers seeking vehicle services and Service Providers offering such services. By using our Platform, you represent that you are at least 18 years old and have the legal capacity to enter into binding agreements.

Important: If you do not agree to these Terms, you must discontinue using the Platform immediately.

2. Description of Services

Connect Auto Care provides a digital platform that enables Customers to describe their vehicle service needs and connects them with qualified Service Providers. Our role is limited to:

  • Facilitating connections between Customers and Service Providers
  • Providing information and tools to aid in service coordination
  • Processing service requests and inquiries
  • Maintaining a communication platform for parties to interact
  • Providing estimates and quotes for services

3. Limited Liability and Disclaimers

3.1 Service Provider Selection: Connect Auto Care does not guarantee the quality, safety, or legality of any Service Provider's work or services. While we strive to maintain our network of qualified providers, each Service Provider is an independent contractor, not an employee of Connect Auto Care. We are not responsible for:

  • The quality or competency of services provided by Service Providers
  • Any damages, injuries, or losses resulting from services performed
  • Breach of contracts between Customers and Service Providers
  • Any warranty claims related to service work
  • Cancellations, rescheduling, or no-shows by Service Providers

3.2 Independent Contractors: All Service Providers using our Platform are independent contractors. They are not employees, agents, or representatives of Autocare Connect. We do not control their business practices, pricing, availability, or quality of work. Each Service Provider operates their own business in accordance with applicable laws.

3.3 No Warranties: The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. Autocare Connect disclaims all warranties, express or implied, including but not limited to:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties regarding the accuracy or completeness of information on the Platform
  • Warranties that the Platform will be uninterrupted or error-free
  • Warranties regarding the availability of Service Providers

4. Customer and Service Provider Responsibilities

4.1 Customers agree to:

  • Provide accurate and truthful information about their vehicle and service needs
  • Respect Service Providers' time and schedule commitments
  • Provide safe access to their vehicle for service work
  • Notify Service Providers of any changes to appointments promptly
  • Pay for services as agreed between the parties
  • Not provide false or misleading information to Service Providers

4.2 Service Providers agree to:

  • Provide accurate information about their qualifications and experience
  • Honor their commitments and scheduled appointments
  • Provide services in a professional and safe manner
  • Maintain all necessary licenses and insurance required by law
  • Comply with all applicable state and federal laws
  • Not misrepresent the scope or nature of services offered

5. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AUTOCARE CONNECT SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Any damages arising from service connections arranged through the Platform
  • Any disputes between Customers and Service Providers
  • Any vehicle damage or personal injury claims
  • Any claims arising from non-performance or poor quality of services

IN NO EVENT SHALL AUTOCARE CONNECT'S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY THE USER FOR SERVICES THROUGH THE PLATFORM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

6. Indemnification

You agree to indemnify, defend, and hold harmless Autocare Connect and its officers, directors, employees, agents, and successors from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use of the Platform
  • Your breach of these Terms
  • Your violation of any applicable law or the rights of any third party
  • Your interaction with other users of the Platform
  • Services arranged through the Platform
  • Any personal injury or property damage arising from services

7. Pricing and Payment

7.1 Estimates and Quotes: All quotes and estimates provided through the Platform are non-binding estimates only. Final pricing may vary based on actual service requirements, parts needed, and labor involved. Service Providers retain the right to adjust pricing based on conditions discovered during service work.

7.2 Payment Terms: Payment terms are negotiated directly between Customers and Service Providers. Autocare Connect is not responsible for payment disputes. Customers are responsible for ensuring they understand and agree to the payment terms before authorizing service work.

7.3 No Refunds: Autocare Connect does not guarantee refunds for services deemed unsatisfactory. Disputes regarding service quality must be resolved directly between the Customer and Service Provider.

8. Warranties on Services

Any warranties or guarantees on service work are provided exclusively by the Service Provider and are not provided or endorsed by Autocare Connect. Customers must verify warranty terms directly with their Service Provider before authorizing work. Autocare Connect makes no representations regarding the validity or enforceability of any warranties offered by Service Providers.

9. Cancellation and Rescheduling Policies

Cancellation and rescheduling policies are determined by individual Service Providers. Customers must contact their assigned Service Provider directly to request cancellations or changes. Autocare Connect is not responsible for cancellation fees, rescheduling charges, or disputes regarding cancellation policies. Terms for cancellations should be confirmed prior to service work beginning.

10. Prohibited Activities

You agree not to engage in any of the following activities while using the Platform:

  • Providing false, fraudulent, or misleading information
  • Harassing, abusing, or threatening other users
  • Attempting to bypass security measures or circumvent the Platform
  • Uploading viruses, malware, or harmful code
  • Copying, reproducing, or modifying Platform content without permission
  • Engaging in any unlawful activities or activities that violate applicable laws
  • Attempting to monopolize or control the Platform
  • Interfering with the normal functioning of the Platform
  • Attempting to connect directly with Service Providers to circumvent the Platform
  • Publishing or sharing private information of other users without consent

11. Intellectual Property Rights

All content on the Autocare Connect Platform, including but not limited to text, graphics, logos, images, and software, is the property of Autocare Connect or its content suppliers and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or transmit any content without prior written permission from Autocare Connect.

12. Account Termination and Service Suspension

12.1 Termination by User: You may terminate your use of the Platform at any time by discontinuing access to the Platform.

12.2 Termination by Autocare Connect: Autocare Connect reserves the right to suspend or terminate your account and access to the Platform at any time, with or without cause, with or without notice, if:

  • You violate these Terms
  • You engage in fraudulent or illegal activities
  • Your conduct is harmful to other users or the Platform
  • Autocare Connect determines in its sole discretion that suspension is necessary

13. Privacy and Data Protection

Your use of the Platform is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding the collection and use of your personal information. By using the Platform, you consent to our collection, use, and sharing of information as described in our Privacy Policy.

14. Dispute Resolution and Arbitration

14.1 Governing Law: These Terms and all disputes arising from or related to the Platform shall be governed by and construed in accordance with the laws of the State of [TO BE FILLED], without regard to its conflict of law principles.

14.2 Arbitration: You agree that any disputes arising from or related to the Platform, these Terms, or your use of the Platform shall be resolved by binding arbitration rather than court proceedings. 14.3 Arbitration Process: Arbitration shall be conducted under the rules of the American Arbitration Association (AAA). 14.4 Small Claims Exception: Notwithstanding the above, claims for small claims may be brought in small claims court if they qualify under applicable law.

14.5 No Class Actions: You agree that arbitration shall be conducted on an individual basis and not as a class action, collective action, or representative action. You waive your right to participate in any class, collective, or representative action against Autocare Connect.

15. Modification of Terms

Autocare Connect reserves the right to modify these Terms at any time. Changes to these Terms will be effective upon posting to the Platform. Your continued use of the Platform following the posting of modified Terms constitutes your acceptance of the modifications. If you do not agree to any modifications, you must discontinue use of the Platform immediately.

16. Modification of Service

Autocare Connect reserves the right to modify, suspend, or discontinue the Platform or any portion thereof at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Platform or services.

17. Third-Party Links and Content

The Platform may contain links to third-party websites and services. Autocare Connect is not responsible for the content, accuracy, or practices of third-party websites. Your use of third-party websites is subject to their own terms and conditions. We encourage you to review the terms and privacy policies of any third-party websites before providing personal information.

18. Compliance with Laws

You agree to comply with all applicable federal, state, and local laws and regulations in your use of the Platform. You are responsible for ensuring that your use of the Platform complies with all applicable laws and regulations in your jurisdiction.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed, and the remaining provisions shall continue in full force and effect to the maximum extent permitted by law.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Autocare Connect concerning the Platform and supersede all prior or contemporaneous agreements, understandings, and negotiations, whether written or oral, between the parties regarding the subject matter.

22. Service Connection Disclaimer

Autocare Connect facilitates connections between Customers and Service Providers. We do not perform, provide, or supervise the actual vehicle services. All service work is performed by independent Service Providers. Before authorizing any service work:

  • Verify that the Service Provider is properly licensed and insured
  • Confirm the scope and cost of services
  • Review warranty terms directly with the Service Provider
  • Understand cancellation and rescheduling policies
  • Ask any questions about the proposed service work

23. Acknowledgment

By using the Autocare Connect Platform, you acknowledge that:

  • You have read and understood these Terms and Conditions
  • You understand that Autocare Connect is a platform for connecting parties and does not provide vehicle services
  • You understand that Service Providers are independent contractors
  • You understand the limitations of liability described herein
  • You assume all risks associated with services arranged through the Platform
  • You agree to release Autocare Connect from any and all claims related to services
